The family department at Tickle Hall Cross Solicitors offers a broad range of services designed to support clients through various family-related legal matters. With sensitivity, professionalism, and extensive expertise, the department ensures that clients receive the best possible advice and representation. Below is an overview of the key services provided:

Divorce and Separation

Navigating the end of a relationship can be one of the most challenging experiences in life. Tickle Hall Cross Solicitors provide clear, compassionate guidance to help clients through divorce or separation. They work to reach amicable settlements whenever possible, promoting mediation and collaborative law to minimize conflict and stress. When necessary, their solicitors are prepared to represent clients in court, advocating effectively to protect their interests and secure fair outcomes.

Divorces are and have been for a few years, no fault based and all the parties need to agree is that the marriage has irretrievably broken down.  There is no finding fault or accusations anymore making the entire process far more people friendly and much less adversarial.

Unfortunately many marriages do breakdown and that is where we can help you to bring it to an end by way of divorce. We can help you cope with all aspects of the process as quickly and painlessly as possible. We will assist in dealing with the division of assets and particularly trying to resolve any issues there may be about the care of your children. Call our freephone on 0800 854379 to book a no-obligation initial free consultation. At TICKLE HALL CROSS there are no hidden extras and no nasty surprises, just an affordable FIXED FEE for divorce petitions of £700.00 plus VAT and court fees of £593.00.

Financial Settlements

Financial disputes can add significant stress to the process of divorce or separation. Tickle Hall Cross Solicitors offer expert advice on the division of assets, spousal maintenance, and the resolution of financial disputes. Their goal is to achieve equitable settlements that reflect the contributions and needs of both parties. The solicitors are skilled negotiators, capable of handling complex financial portfolios and ensuring that settlements are fair and sustainable.

Since there are no hard and fast rules regarding your financial rights in the breakdown of a relationship the law in this area is very flexible to enable Courts to achieve fairness depending on your individual circumstances. We will advise you on your legal options and realistic expectations.

When a marriage or civil partnership breaks down, the assets and liabilities of both parties form the pot of assets that are divided between them, as part of the financial settlement. It is often better to agree terms of financial settlement than to delegate that decision to the Court. We can help you to reach an agreed settlement where you retain control over the terms of the final arrangements where appropriate. A pension is usually the second most significant capital asset in a marriage or Civil Partnership. As such, it is important that pensions are considered in the financial settlement if a couple decides to divorce or dissolve their civil partnership. Please use our freephone on 0800 854379 to book an initial free consultation about your circumstances.

Prenuptial and Postnuptial Agreements

Preparing for marriage or civil partnership involves more than just planning the ceremony. Tickle Hall Cross Solicitors help clients safeguard their assets and establish clear agreements regarding financial arrangements and property ownership through prenuptial and postnuptial agreements. These agreements provide peace of mind, setting out terms that can prevent disputes and ensure clarity in the event of a relationship breakdown.

The Civil Partnership Act

The Civil Partnership Act came into force on the 5 December 2005 enabling same sex couples to register a civil partnership. The significance of this legislation is that the same sex couples, after the registration and Civil Ceremony, become each other’s next of kin for inheritance purposes. The registration puts their relationship and their finances on the same footing as married couples.

In addition the Civil Partnership Act makes provision for the acquisition of parental responsibility for the child or children of civil partners a kin to the mechanism used for by the step parents after a marriage, either by agreement or by consent. It will also allow a party the same status as a spouse in Adoption proceedings.

It is inevitable that, as with marriages, some Civil Partnerships will fail. The law facilitating Civil Partnerships also provides the means to terminate, or dissolve, that legal status. The principles and procedures are very similar to those involved in a divorce process. Civil Partners will also enjoy similar financial rights and remedies as married couples, affording them a much higher level of protection and indeed justice in the difficult circumstances of a relationship failure. This is an emerging area of the law in respect of which we have undertaken specialist training. We understand the importance to you of quality legal advice and support and we are well equipped to find the right solution for you as swiftly and as amicably as possible. If you need to talk things through with a qualified advisor, call our freephone on 0800 854379 to book an initial free consultation.

Unmarried Couples

When unmarried couples sperate the legal landscape can be quite different from that of married couples.  While the specific laws can vary by jurisdiction, there are some common principles that generally apply.

Children Matters and Support

The wellbeing of children is always a paramount concern in cases of divorce or separation. The family department at Tickle Hall Cross Solicitors prioritises the needs of the children, striving to establish child arrangements that promote stability and continuity in their lives.

We advise on Children Act Issues and Child Arrangement Orders ensuring agreements serve the best interest of the child/children.

Decisions will need to be made about where they will live and how best to ensure that they benefit from ongoing contact with both parents. You know your children best so we will encourage you where possible to maintain dialogue with your partner and to make agreed and constructive arrangements with them. Disputes between parents can often arise when couples separate. You may disagree as to where the child should live, whether the child should see one of the parents and if so arrangements or specific issues such as the choice of schooling etc.

If you are unable to agree on the arrangements you may ask the Court to decide the matter for you. With our experience and expertise we will be able to guide you through this process and help you to achieve the future arrangements you feel will be in the best interest of the family.

We can advise clients with regard to the various Orders which the Court can make including residence, contact, prohibited steps, specific issues and parental responsibility. Call our freephone today on 0800 854379 to book an initial free consultation.
